This Online Privacy Policy (“Policy”) explains what personal information and data (“personal information”) Socialbud, LLC (referred to herein as “Socialbud”, “we”, “our”, or “us”) collects through our websites, mobile app, and other Socialbud services (the “Site(s)”), how we use that information, to whom we sell or share it, how long we retain it, and how we safeguard it. Personal information is any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to a particular consumer or household. Unless indicated otherwise, this Policy applies only to personal information collected through the Sites that expressly adopt or link to this Policy, and then only to the extent indicated (collectively, the “Services”).


  1. Scope of This Policy

This Policy applies to any individual, corporate entity, agent, or affiliate (collectively, “you” or “your”) that engages with Socialbud to utilize the Services. This Policy governs the collection, use, and disclosure of any personal information provided by you. 


  1. Information We Collect

We may collect personal information at various places in our Services, such as when you create an account; communicate with our chatbot; engage with our mobile applications; communicate with us through email; upload content to create posts; or submit payment information. We may also collect information that you provide on our Services about people you know, such as social media contacts or other social media engagement information. When you interact or communicate with us, you may also interact and communicate with or through our third-party service providers and their technologies. For example, our automated chatbots are provided by our third-party service providers, who process, record, and retain all chats (including the content of chats and information relating to your interactions) on our behalf. Some functionalities and experiences within our Services, such as our chatbot experiences, are facilitated by AI, including generative AI ("GenAI"). We also collect various types of information to provide, maintain, and improve our Services.


Information You Provide 

The types of information we collect from you may include:

  • Full Name: Used for account identification and communication.

  • Billing Address, City, State, Zip Code, Country: Used for invoicing and payment processing.

  • Email Address: Used for account creation, communication, and notifications.

  • Password: Used to secure your account.

  • Credit Card Information: Used for payment processing.

  • Name of Your Brand: Helps us tailor our Services to your brand.

  • Website (Optional): Provides additional context about your brand.

  • Customer Service Chats: Helps us improve our support and Services.

  • Chats with Chatbot: Used to enhance our chatbot's performance and provide better assistance.

  • Social Media Handles: Allows us to connect and manage your social media accounts.

  • Preferred Style (e.g., Modern): Helps us customize your content to match your brand's style.

  • Brand Colors: Used to ensure consistency in your branding.

  • Font Preferences (e.g., Modern or Classic): Helps us match your brand's aesthetic.

  • Information About Your Business: Provides context about your business operations.

  • Information About Your Customers: Helps us understand your target audience.

  • Information About Your Goals: Assists us in aligning our Services with your objectives.

  • Information About Your Marketing Strategy: Helps us tailor our Services to your marketing needs.

  • Specific Topics You’d Like to Post About: Guides our content creation process.

  • Language Preferences: Used for content generation.

  • Time Zone: Used to facilitate posting content to social media at advantageous times.

  • Content You Share (Photos, Captions, Design, etc.): Used to create and manage your social media posts.

  • Date or Time You Would Like to Schedule the Posts: Helps us schedule your posts at optimal times.

  • Edits to Generated Posts (Content You Create): Used to refine and improve the content we generate for you.


Information Your Devices Provide Automatically

We may obtain information about your approximate and, with your permission, precise geolocation when you access or use our Services. For example, we collect information via your browser information and other similar device or browser attributes (like IP address), or our mobile applications. If you wish to turn this off, please click on Customize. When you access our Services, your computer, phone, or other device may provide navigational information, such as browser type and version, service-provider identification, IP address, the site or online service from which you came, and the site or online service to which you navigate. We also may obtain information about the computer or mobile device you use to access our Services, such as the hardware model, operating system and version, identification numbers assigned to your mobile device.


To better understand how you interact with our Services, we may collect information using cookies, clear gifs (also known as web beacons or web bugs), analytics services (such as session replay software), and other similar technologies (collectively, “Website Technologies”).  We may use information collected through Website Technologies to deliver Services to you; enable you to sign-in to your account; remember your preferences and settings; improve our business; recognize other devices within your household; combat fraud; and market our Sites and Services on this and other online services through a variety of media like email, mobile advertising, direct mail, and social media.


A cookie is a text file with small amount of data that is stored by your browser on your device. It's used to do things like understand how you use our Services, such as what you click on, and remember you and your account information. This helps us improve and deliver our Services, provide better customer service, tailor and improve your experience, and deliver marketing campaigns and track their performance. Cookies may also be used by third-party service providers to analyze your interests and show you relevant advertisements on other sites. If you do not allow these cookies, you will experience less targeted advertising but some of our Services may not function as well or at all. If you do not want cookies to track your activity, you can opt-out by adjusting your browser settings to refuse cookies or by changing your cookie preferences and settings for our Sites and Services at any time by clicking on Customize.

We may also use device identifiers, web storage, third-party analytics services, such as session replay services, and other similar technologies and services, to collect information about your interactions with our content and Services. Session replay services consist of an analytics application that allows us to capture and analyze your interaction with our Services to better and repair any technical errors and optimize our Services. Such technologies and third-party services may observe or record your activities when using our Services, including movements, scrolling, visit duration, clicks, information typed, and other interactions. To facilitate our Services, we enable our third-party service providers to be part of your communications and interactive experiences with us. When you interact or communicate with us, you are also interacting and communicating with or through our third-party service providers and their technologies. These technologies may be used to help us understand which of our Services you like most. 


We may incorporate third-party Software Development Kits (SDKs) within our applications to enhance functionality and improve user experience. These SDKs may collect various types of information, including device information (e.g., device type, operating system, unique device identifiers), usage data (e.g., interaction with the app, features used, session duration), and location data (if you have granted permission for location access). The information collected by these SDKs is used to analyze and improve the performance and usability of our applications, provide personalized content and recommendations, monitor and prevent fraudulent activities, and comply with legal and regulatory requirements. We ensure that any third-party SDKs integrated into our applications adhere to our privacy standards and are compliant with applicable data protection laws. By using our applications, you consent to the collection and use of information by these SDKs as described in this policy.


Information Derived Through or Provided by Others

Corporate entities, sister brands, vendors, social media networks, advertising networks, and other affiliates may provide us with, or supplement, information about you. We may use this information to enhance our Services and content generation, for operational or marketing purposes, to improve our business, and transact business.


  1. How We Use the Information We Obtain

We may use the personal information we obtain to provide our Services, such as to:

  • Operate our Services.

  • Facilitate payment and transactions.

  • Create and manage your Socialbud account.

  • Personalize your Socialbud experience with content tailored to your needs.

  • Provide customer service and respond to your inquiries and requests.

  • Enable you to post your content, such as captions, images or videos.

  • Facilitate networks of online social media activity centered around your products and services.

  • Improve our Services.

  • Develop, train, use, and improve AI tools and models (including those provided by third-party service providers) with the personal information described in this Policy for certain business purposes, such as to analyze customers' experiences and activities with us, to improve the efficiency, quality, and speed of our business operations, to support communications with you and make product recommendations (such as through our chatbot(s)), to generate business content, and to provide personalized experiences.

  • Enable you to interact with third-party service providers that create content, whether by linking to their sites, viewing their content within our environment, or by viewing our content within their online environment.

  • Market our Sites and Services that may be of interest to you.

  • Create aggregated, de-identified, or anonymized information for statistical purposes, which we will maintain and use in a non-individually identifiable form and will not attempt to re-identify the data.

  • Ensure our technology integrity by maintaining and improving our networks, identifying and fixing problems, and enhance the security of our Sites and Services, protect your rights, and safeguard the rights of others.


  1. Information Shared with Third Parties

Except with your consent or as described in this Policy, we do not disclose personal information collected on the Site with third parties.  We may disclose your personal information to third parties for any of the purposes listed above. 


We may disclose personal information to third parties as follows:

  • Social Media Platforms. As part of our Services, we will share content you provide to us with social media platforms at your direction. If you include personal information in your content, that information may be shared to external audiences, such as your followers.

  • Third-Party Service Providers. We may utilize third-party service providers for payment processing, customer service, connectivity to social media platforms, analytics, AI content generation, data libraries, marketing, and security and maintenance of our technology. We may disclose personal information to such third-party service providers to support our business operations as described in this Policy and our Terms of Use. 

  • Legal Obligations and Rights. We may disclose your personal information to law enforcement agencies, regulatory authorities, or other governmental bodies when required by law or in response to valid requests, such as subpoenas, court orders, or other legal processes. We may also disclose personal information where we believe it is necessary to protect or exercise our legal rights.

  • Transactions. In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, we may transfer or disclose your personal information to the relevant third parties involved in the transaction. This transfer or disclosure will be conducted in accordance with applicable privacy laws and regulations. The receiving party will be required to protect your personal information in a manner that is consistent with this Policy.

  • Corporate. We may disclose your personal information to our legal and accounting professionals when necessary to comply with our legal obligations, as part of our financial or audit requirements, or as part of our general business operations.

  • Forums. Our Services may include forums, message boards, chat rooms, or other interactive features where you can post content and communicate with other users. Please be aware that any information you disclose in these areas becomes public information and may be read, collected, and used by others who access them. We are not responsible for the privacy practices of other users or third parties who may view and use the posted information.

  • Notice Regarding Chatbot Experiences and Artificial Intelligence. When you interact or communicate with us, you may interact and/or communicate with, or through, our third-party service providers and their technologies. The automated chatbots are provided to you by our third-party service providers.  We and our third-party service providers may process, record, and retain all chats (including the content of chats and information relating to your interactions). Some functionalities and experiences within our Services are facilitated by AI, including generative artificial intelligence ("GenAI"). For a full description of our policies and guidelines related to the chatbot and its uses, please refer to https://socialbud.com/terms-of-service (the “Terms of Use”). PLEASE DO NOT UPLOAD OR SHARE ANY PERSONAL INFORMATION TO THE CHATBOT. DISCLOSURE OF PERSONAL INFORMATION TO THE CHATBOT IS DONE AT YOUR OWN RISK.

  • Other. We may share or disclose information, including personal information, to: (i) protect or defend our interests and the legal rights or property of Socialbud; (ii) protect the rights, interest and safety and security of users of our Site or members of the public; (iii) protect against fraud or for risk management purposes; or (iv) comply with prudent legal practice as we may determine, applicable law or legal process. In addition, if we sell all or substantially all of our business, or sell or transfer all or a material part of our assets, or are otherwise involved in a merger or transfer of all or a material part of our business (including transfers made as part of insolvency or bankruptcy proceedings), we may transfer all information we have collected and stored, including your Personal Information, to the party or parties involved in the transaction as part of that transaction.

We may sell or disclose non-personally identifiable data, including anonymized or aggregated data derived from personal information collected from the Site to third parties, such as marketing businesses and lead generation businesses, for any purpose.


  1. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, as disclosed in this privacy policy, or as required by law. Data retention periods may vary depending on the type of data and the applicable legal requirements. We implement data retention schedules to ensure that personal information is not kept longer than necessary. Once the retention period expires, we securely delete, de-identify, or anonymize your personal information unless retention is required for legal compliance, dispute resolutions, or fraud prevention. By using our Services, you consent to our data retention practices as described in this Policy.


  1. Notice Regarding Use of the Services by Children

Our Services are not intended for use by children under the age of sixteen (16). We do not knowingly collect personal information from children under 16. If we become aware that we have inadvertently received personal information from a child under 16, we will take steps to delete such information from our records. By using our Services, you confirm that you are at least 16 years old.


  1. Your Choices.

You are able to make certain choices about how we communicate with you and the information we collect from you and share with third parties. You may choose not to receive marketing email communications from us by clicking on the unsubscribe link in our marketing emails, adjusting your email preferences via the hyperlink provided via your settings page on the Site, or contacting us as specified in the “Contact Us” section below. You may still receive service oriented, administrative communications from us as you cannot opt-out of receiving such administrative communications.


  1. Security

We maintain measures designed to safeguard personal information in our possession. Despite these measures, we cannot guarantee the security of networks, servers and databases we operate or that are operated on our behalf or that the information you transmit to Socialbud over the Internet will not be intercepted, deleted or altered. Therefore, although we work to protect your privacy, we cannot promise, and you should not expect, that personal information or communications you transmit via the Internet are guaranteed to remain secure.


  1. Data Transfers

We provide our Services in accordance with the laws of the United States. If you are located outside the United States, please note that we may transfer the personal information we collect about you to countries other than the country in which the information originally was collected. Those countries may not have the same data protection laws as the country in which you initially provided the information. When we transfer your information to other countries, we will protect that information as described in this Policy and in accordance with applicable law.


  1. Do Not Track

Some newer web browsers may have a "Do Not Track" preference that transmits a "Do Not Track" header to the websites you visit with information indicating that you do not want your activity to be tracked. Site does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. We continue to review new technologies and may adopt a standard once one is created.

  1. Links and Integrations.

The Site may contain links to functionalities, products, websites, or web pages not operated by Socialbud. Once you leave the Site, we suggest that you review the applicable privacy policy of the third-party website regarding, among other things, how they will handle any personal information they collect from you. We are not responsible for the content of any websites that are not affiliated with Socialbud, any use of those websites, or the privacy practices of those websites.


  1. Updates to Our Policy

We may update this Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. When we make changes, we will update the "Last Updated" date at the beginning of this Policy. We encourage you to review this Policy periodically to stay informed about our privacy practices.

Sensitive Personal Information.  

We do not use or disclose sensitive personal information for purposes that, under applicable law, require us to offer you a right to limit the use or disclosure of sensitive personal information.


Use of Personal Information

We use the personal information we collect for our operational purposes, including all purposes notified to you in the above section titled “How Use the Information We Obtain.” In addition to the purposes described above for which we use personal information, we may use personal information for the following business purposes:

  • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with the state privacy laws and other standards;

  • Helping to ensure security and integrity to the extent the use of the consumer’s Personal Information is reasonably necessary and proportionate for these purposes;

  • Debugging to identify and repair errors in our systems;

  • Short-term, transient use including non-personalized advertising shown as part of a consumer’s current interaction with us;

  • Providing services on our behalf or on behalf of others, including maintaining or servicing accounts, providing customer service, fulfilling transactions, verifying identity information, processing payments, and other services;

  • Conducting internal research to develop and demonstrate technology; and

  • Conducting activity to verify, enhance, and maintain the quality or safety of services or devices which we may own, control, or provide, or to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for us, or controlled by us.


Disclosure of Personal Information

We have disclosed Personal Information listed in all or substantially all of the above categories (A)-(G) for our business purposes within the 12 months preceding the effective date of this Notice. We list the categories of third parties to whom we may disclose Personal Information in the above section titled “Information Shared with Third Parties”.

We may sell or disclose personal information in exchange for monetary or other valuable consideration, and share your information for targeted or cross-context behavioral advertising.  As is common practice among businesses that operate Internet websites and mobile apps, within the past 12 months, we may have shared certain identifiers, information about the use of our Sites, and inferences drawn about you to our social media, advertising, and analytics partners. Under certain state laws, this may be considered to be a sale of Personal Information for valuable consideration or sharing of Personal Information for cross-context behavioral or targeted advertising.  We do not sell or share Personal Information of individuals we know to be under the age of 16.


State Specific Privacy Rights

Your rights may include: 

  • Right to Know. You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting or selling personal information, and the categories of third parties with whom we share personal information.

  • Right to Correct. You have the right to request that we correct inaccurate personal information that we have collected about you.

  • Right to Delete. You have the right to request that we delete personal information about you that we have collected from or about you. Please note, our Services require the use of your personal information, we may not be able to provide our Services if you choose to delete your personal information.

  • Right to Opt-Out of Selling and Sharing. If we sell your personal information for valuable consideration or share your personal information for cross-context behavioral or targeted advertising, you have the right to opt-out of such sale or sharing. To submit an opt-out request or a request to limit use clicking on our Customize.


Additionally, we will process opt-out requests submitted by your opt-out preference signals as required by applicable law. The technical specifications of your opt-out preference signals determine how we process such signals. For example, if you install opt-out preference technology on a browser, and the opt-out preference signal it sends is associated solely with your browser, the opt-out will be applied to the browser. As of the “Last Updated” date of this Notice, our processing of opt-out preference signals can be considered “frictionless” under California law.

  • Right to Appeal. If you receive our refusal to fulfill a previous request that you submitted, you have the right to appeal such refusal.

  • Right to Non-Discrimination. You have the right to not be discriminated against for exercising any of the above described rights. 

For security purposes and as required under applicable law, we may take steps to verify your identity before granting you access to information or acting on your request to exercise your rights. We may limit our response to your exercise of the above rights as permitted under applicable law. If you use an authorized agent to make a request on your behalf, we may require proof of authorization.
